1. Acceptance of Terms of Use and Amendents

The following General Conditions, define the relationship between the shop of Elise (or “we” or “us”) and the buyer (“you” or the “buyer”) of the product (“Work”) sold in connection with the website at https://www.elifoodre.com (the “Website”), and apply to all products and services offered for sale on it and for all deliveries. Every order implies the general conditions of sale are accepted.

By accessing and using our website and making an order, you accept and agree to be bound by these Terms and Conditions and any other policies. Please see our Privacy Policy.

Only Belgian Law applies to the General Conditions of the shop of Elise.

2. Purchase and payment

The agreement between the shop of Elise and the buyer is realised as soon as the buyer has accepted the conditions made by the shop shop of Elise and agreed with them. The lack of a traditional signature does not affect the obligatory character of the offer and its acceptation. Only persons aged 18 years or older may order at this Website. The shop of Elise has the right to refuse an order to subject it to extra conditions, for instance for orders placed by minors, when the order procedures have not been completely executed or when previous orders have caused problems. Payment of products bought at the shop of Elise  can exclusively be made by the available methods of payment on the website offered by Stripe. To guarantee safe online payment and the safety of your personal data, transactions are made via a universal payment service provider (Stripe) , and therefore we do not have access to the data specifically used for this purpose. The seller remains the owner of the goods until payment has been completed. When payment is not made in due time, the shop of Elise has got the authority to cancel the agreement immediately or to delay (further) delivery of the goods till full payment has been made. The shop of Elise will always confirm the order by email. As long as a confirmation email has not been received by the customer, the order is not valid. The general conditions and the confirmation mails are always stated in the language of the website.

3. Delivery

Our products are delivered in Europe. Deliveries are made through a courier or registered post service, unless previous to the agreement, another way of delivery was agreed upon. The costumer will be informed about shipping and delivery costs ( which varies on the destination country)  during checkout,  before your purchase is confirmed. The orders are shipped biweekly.  Once your order has been shipped,  you will receive a confirmation e-mail. The stated delivery times are indicative forecasts, and are based on the assumption of normal operation of services. In the case of temporary unavailability of a product or exceptional circumstances , we will clearly indicate when it will be available again and/or shipped. As soon as the goods have been delivered at the delivery address, the risk concerning these products is the purchaser’s responsibility.

4. Product information

We provide information, images, price quotes concerning the goods offered and the main characteristics of the goods given by email as accurately as possible. For every product availability is mentioned. The shop of Elifoodre (Elise Coudré) tries to provide correct information, yet it can occur that goods cannot be delivered immediately, due to unintentional wrong stock data (at non limited editions products) or due to Circumstances beyond our control. In such a case the shop of Elifoodre (Elise Coudré) will contact you as soon as possible.

5. Prices

Before settling the bill you are notified of the price of the goods. All prices are in euro and include VAT.  Shipment costs are mentioned separately, when selecting a destination during checkout. The prices and other descriptions are subject to unannounced alterations. Any alteration to the prices shall only have an impact on new orders and do not affect any other orders that have already been concluded.

6. Right of withdrawal

In accordance with the applicable laws, the customer has the right to withdraw from the online or mail purchase without penalty and without specifying the reason. You may cancel or return your order from the date you place the order until 14 calendar days after the delivery of the ordered items. If you have been charged for the items, you will receive a refund which will exclude delivery costs. During this period we expect you to handle the goods and the package material carefully. The right to cancel the purchase is not possible when the product and the package material are no longer original, undamaged and unused. When you want to cancel the purchase, you must inform us by registered letter or by email within 14 calendar days following the day of delivery of the goods. The goods must be returned undamaged, unused and unopened (in their original packaging) at the very latest 14 days after delivery, with a traceable shipping service . The purchaser pays the shipping costs of the returned goods. We will  refund you  for the amount of the rescinded purchase , via the payment method that you have originally selected, within 30 days after the goods have been returned. If goods have not been returned in accordance with the conditions of the right to cancel, the amount of the purchase, will not or not completely be returned. The product , in this case, remains your property. On your demand the goods can be sent back to you on the condition of payment of the shipping costs. Exceptions on the withdrawal conditions stated here: The Customer may not exercise the right of withdrawal in relation to contracts concluded for products made according to the Customer’s specifications or customised for the Customer, products that are liable to deteriorate.

7. Warranties

All products sold at the shop of Elifoodre (Elise Coudré) are covered by a legal warranty. Upon reception of the order, the Customer undertakes to check whether the products have any apparent defect, and the product shall be considered to be delivered without any damages, when it is accepted without any reservations. In the event of damages to the product or any apparent defects, the Customer should not accept the order, and should immediately return it. The customer is obliged to control the goods thoroughly immediately after receiving them. He has to control whether the goods are conform to the agreement: When a clear, manifest fault is found it must be reported to us, by email,  within 7 working days after delivery. If a complaint is accepted our liability is limited to exchanging the goods. The liability of the seller is limited to the amount paid for every order.

8. Circumstances beyond our control

These are all external causes, anticipated or not, and on which the shop of Elise cannot exert any influence, yet which make it impossible for the shop of Elise to meet its commitments. The shop of Elise has the right to appeal to ‘Circumstances beyond our control’ if the circumstances that make it impossible to meet its commitments occur after the shop of Elise should have met its commitments. In such a situation delivery and other obligations of the shop of Elise are cancelled. If this period is longer than 8 weeks, both parties can undo the agreement, without any obligation of compensation.

9. Disagreements and Applicable Law

Exclusively Belgian Law applies on all offers and agreements, without giving effect to any principles of law. In the case of dispute, only the courts of Antwerp, Belgium has jurisdiction.

10. Privacy

With placing an order in our webshop you accept our privacy policy as it is made available on our website. You are accepting that we collect the personal information you submitted -including your name, address, email address, telephone number,  personal preferences. We will have to provide some of this information to  our service suppliers, as logistics companies. Besides that, we never provide third parties with this information, but we will only use this for optimization of your purchases in the future and to keep you up to date (when agreed with signing in for the newsletter).
